Terms of service and use
What we agree when you create an account or subscribe to a plan on andarama.com, written to be understood.
1. Who provides the service and what these terms cover
The hosted Andarama service (andarama.com and app.andarama.com) is provided by José Luis Saorín Ferrer, NIF (Spanish tax ID) 79081262V, with registered address at Santa Cruz de Tenerife (Spain) and email jl@joseluissaorin.com. These terms apply to the use of your account and to subscribing to plans. The Andarama program, when you install it yourself, is governed only by its open-source licence (EUPL-1.2), not by these terms.
2. Your account
You must be at least 14 years old to create an account and have legal capacity to contract to subscribe to a paid plan. Sign-up and sign-in are handled by Clerk. You are responsible for keeping your access safe and for what is done with your account; if you suspect misuse, let us know.
3. Subscribing
Plans are purchased on app.andarama.com: you choose the plan and billing period, review the price and pay by card through the payment gateway (Clerk, with Stripe as processor). The contract is concluded when the payment is confirmed, and you receive the receipt by email. The contract is concluded in Spanish; translations of these terms are for information only and, in case of any discrepancy, the Spanish version prevails.
Institutions and companies can also purchase with a quote and an invoice in euros: the contract is concluded when they accept the quote or send us the purchase order.
4. Prices and taxes
Current prices are on the pricing page. By card they are charged in US dollars (USD); your bank handles the exchange. By invoice, in euros. Any applicable indirect taxes (VAT, IGIC or others) are applied according to the regulations and the customer's location, and are itemised on the invoice. If a price changes, we will notify you by email at least 30 days before the next renewal, and you can cancel before it applies.
5. Free trial
When you create your account you get a 14-day trial with no card, with 1 tour and 500 MB of media; what you publish during the trial carries the “Made with Andarama” badge. The trial does not turn into a paid plan on its own. When it ends, what you created is kept and can be exported, and you need a plan to create or upload more.
6. Renewal and cancellation
Monthly and yearly plans renew automatically at the end of each period for the same amount, unless a price change has been notified. You can cancel renewal whenever you like from your account: the plan stays active until the end of the period already paid and you are not charged again. Periods already started are not refunded, except where the law requires it.
The De por vida plan is a one-off payment and lasts for as long as the hosted service at andarama.com is provided. If it ever ceased to be provided, you would be notified at least 90 days in advance so you can export everything or move it to a self-hosted install.
7. Right of withdrawal
If you are a consumer, you generally have 14 calendar days to withdraw from a distance contract. Andarama plans are digital content not supplied on a tangible medium: when you subscribe you expressly request that the plan be activated immediately and you accept that you therefore lose the right of withdrawal once performance has begun, in accordance with article 103 m) of the Spanish consumer protection act (texto refundido de la Ley General para la Defensa de los Consumidores y Usuarios, Real Decreto Legislativo 1/2007). That is why we offer a 14-day trial with no card first.
If you did not give that consent, or the plan has not yet been activated, you can withdraw within 14 days by writing to jl@joseluissaorin.com (you can use the model form in annex B of that act, or any clear message), and we will refund the amount within 14 days at most using the same payment method. Companies and institutions are not consumers for these purposes.
8. Acceptable use and content
You are responsible for what you upload and publish, and for holding the rights to it (photos, texts, audio, video, trademarks and the image of any people who appear). You may not use the service for unlawful content, to infringe the rights of others, to distribute malware or to overload it on purpose. We may remove content or suspend an account that breaks these rules, notifying you unless the seriousness of the case or the law prevents it.
Plans have tour and storage quotas and a fair-use policy: they are meant for one person or a small team. If usage stops looking like that, we talk to you before cutting anything off.
9. Availability and support
We work to keep the service always available, but there may be interruptions for maintenance, provider failures or causes beyond our control. Unless agreed in writing, there is no guaranteed service level. Support is provided by email.
10. Your data and export
What you create is yours. You can export your tours at any time and on any plan, also after the trial or after cancelling: static ZIP, single HTML file, PWA and the .andarama file. If you cancel, your tours and media are kept for as long as the account exists; if you request deletion by email, they are erased within 30 days at most, as explained in the privacy policy. For institutions and companies we prepare, on request, the data processing agreement under article 28 of the GDPR.
11. Liability
We are responsible for providing the service with due diligence. Except in cases of wilful misconduct or gross negligence, and except for what the law does not allow to be limited towards consumers, our liability is limited to the amount paid in the twelve months before the event giving rise to it. We recommend keeping the originals of your photographs and exporting your tours from time to time.
12. Changes to these terms
If these terms change in a significant way, we will notify you by email at least 30 days in advance. If you do not agree, you can cancel before they take effect.
13. Governing law and jurisdiction
These terms are governed by Spanish law. If you are a consumer, you may go to the courts of your place of residence; in all other cases, the parties submit to the courts and tribunals of Santa Cruz de Tenerife. Before anything else, write to us: almost everything gets sorted with an email.
